Website Development Terms
These terms may be subject to change and should you continue to accept them it shall be the assumption of Mut-Con that you agree with the terms.
Website Pricing
All pricing for Mut-Con websites can be found at https://mut-con.co.za/shop/online-strategy-webdev/web-development/website-development. Pricing applies to standard and standard e-commerce websites. All custom and custom e-commerce websites are custom-priced after the client’s desired design and scope of work have been presented.
Definition Of Terms

Standard Website
This refers to a standard catalogue website built using a theme. The theme may be presented by the client or the client may leave it up to Mut-Con to select a relevant theme based on our expertise. Where the client wishes to go with a specific theme and the theme is a paid-for theme, the cost of the theme will be added to the cost of the website.
Custom Website
This refers to a website designed and built to the client’s exact specifications. Where a client wishes to create a custom website for the purpose of building a unique website, it is on the client to provide the design of the website or engage Mut-Con to have their design built with the help of a UX and UI designer at a cost to the client.
E-commerce Website
This refers to any website that includes online commerce capabilities. E-commerce websites can be both standard and custom websites. The terms that apply to each website type will apply to the corresponding e-commerce websites. Only websites designed to sell standard products or services as per the functionality available in WooCommerce or Shopify shall be considered standard. Additional eCommerce functionality “customised” to the needs of specific clients shall render a website a custom e-commerce website. The delineation between the two website types will be left up to Mut-Con.
Landing Page
Any single-page website built specifically for the purposes of a marketing drive of a singular event, with the goal of collecting leads for the business. Landing pages differ from one-page websites as the latter are built for the purposes of informing and marketing like their multi-page counterparts while landing pages are built expressly for the purposes of lead generation. All landing pages are a hybrid of standard and custom websites.
Delivery Of Service
The delivery of service will be determined by the type of website in question and will be assumed in the definition that is invoiced and accepted by the client.
Definition of the Website
The client will be provided with a definition of the website, standard or custom, e-commerce or catalogue at the beginning of each project. This definition will be invoiced and explicitly quoted in the invoice. Acceptance of the invoice will mean the client accepts the definition of the project and the terms associated with each definition will apply to the project.
Cost of the website
The cost of the website quoted on the pricing page can be subject to revision up or down by Mut-Con prior to the commencement of the project. This can be due to a number of circumstances including dialogue between the two parties, but MUt-Con can only be held to said cost if expressly agreed upon and invoiced. Mut-Con will not revise a quoted price for the duration of the official quote or the invoiced price once the invoice has been accepted by the client within a reasonable period, generally accepted to be two months. All custom websites are subject to a non-standard costing and have a price provided upon submission of the complete scope, which includes all the wireframes and the functionality of the website. An invoice shall only be deemed binding to Mut-Con when the email with the invoice is responded to with “accepted” by a representative of the client.
Manipulating the quote
The client shall not make representations that understate the work that will be involved for Mut-Con so that the agreed-upon price is less than would have been quoted by Mut-Con. Some of these practices include but are not limited to:
- Representing the website as a standard website while the scope of the work is custom in nature.
- Representing a website as standard while the required website is an e-commerce website.
- Understating the scope of work, e.g. the required number of pages and functionality so as to later make additions when the price has been quoted so as to manipulate the cost.
- Making significant additions to the website during the support period provided for free so as to significantly alter its scope without having to make additional payments.
Any attempts to do any of the above shall give Mut-Con the right to alter the price of the website even after a price is agreed upon. Where a client is genuinely unsure of the direction they want to go with their website before commencement, they are to make Mut-Con fully aware of this, or Mut-Con will view any such attempts as an attempt to circumvent our pricing policies.
Website Completion
All standard websites, including standard eCommerce websites, will be completed in five working days from the client providing the necessary resources for the project. These working days shall exclude Saturdays and Sundays as well as holidays recognised by the Republic of South Africa. Except where expressly discussed with Mut-Con, weekends and recognised public holidays do not constitute working days for Mut-Con, and Mut-Con is not compelled to provide services on these days. All custom websites shall be completed in a period of ten working days. Additional days may be required and will be communicated by Mut-Con if the scope of a custom website is significant. The onus will always be on the client to provide the resources required to complete the project, and any delay in providing said resources will be added to the number of days required to complete a project. Where a client agrees to have their project handled by Mut-Con where Mut-Con has expressly stated a limitation of capacity, the client shall recognise the additional time required to complete the website.
A client can request to have multiple web projects run simultaneously provided Mut-Con has the capacity, but the client shall acknowledge that each of these projects is independent of another.
Required Resources
- Access to an adequate hosting facility. Unless previously discussed with Mut-Con, all clients will be required to give Mut-Con access to their hosting facilities for the purposes of building their website.
- An appropriate theme. For all standard websites, where the client does not give Mut-Con the choice of theme to use for the website, the client shall provide Mut-Con with the cost of the theme as well as direct Mut-Con towards the theme they wish to have used on their website.
- The wireframe as well as the elements of their website. For all custom websites, the client shall provide MUt-Con with a full wireframe of the website. The platform for the wireframe will not matter, but the wireframe will include all the pages of the client’s website as well as all the content, copy and graphics within those pages. Any pages or content not included in the wireframe cannot be held as the responsibility of Mut-Con. Unless otherwise discussed with Mut-Con, this wireframe will be taken religiously by Mut-Con and any changes to pages or sections of pages in the final product after a draft is presented shall constitute additional scope to the website.
- Copy. Unless previously agreed with Mut-Con, the wording of every section of the website will be considered the responsibility of the client.
- Graphics. Unless previously agreed with Mut-Con, the graphics, including videos, photos, gifs, and all other visual elements of the website that don’t form part of its code shall be the responsibility of the client.
- Scope of functionality. Unless where the client expresses to Mut-Con a need to make additions after the fact, it shall be their responsibility to specify the scope of the functionality needed on their website.
- All resources, at the start, during or for the conclusion of a project shall be communicated via email, or shared via a reputable cloud service, e.g. Google Docs or Zoho Files, unless otherwise communicated with Mut-Con.
Even where previously discussed with Mut-Con, any additional scope in terms of functionality or size of the website shall extend a right to Mut-Con to extend the time to completion by a reasonable time as well as to revise the cost of the project.
Terms of payment
Unless otherwise agreed with Mut-Con, all standard website projects shall require a deposit of 70% to commence. It is at the discretion of the client to pay the full amount of the website cost. All custom website projects will be paid for on the project’s agreed-upon milestones. Where no such milestones exist, the 70 – 30 split will be assumed. The balance of the cost is payable upon satisfactory completion of the project. The client shall not delay the project beyond reason to delay their project balance coming due.
Refund Policy
Subject to the meeting of specific criteria, the client shall be subject to full or partial refund on their project. The following shall generally apply to refunds:
- All domains and hosting purchased on behalf of the client are not refundable. Clients are advised to be sure of their desired domain names as domains, even wrong ones, are not refundable. All domain names are to be provided in writing to provide a record of the desired domain.
- The client shall not agree to an invoice, pay partial or full amount on their invoice and then request a refund. In such cases, it is at the discretion of Mut-Con to agree to the refund, the client shall otherwise be compelled to complete their project.
- The client shall not use any underhanded tactic to delay the completion of their project for the purposes of compelling Mut-Con to refund them on the grounds of not meeting deadlines.
- The client shall not intentionally misrepresent the scope of their project at completion to compel Mut-Con to provide a refund on the grounds of non-delivery.
- A reasonable man test will be applied in determining if Mut-Con met the deliverable standard for a website. Where Mut-Con is deemed to not have by any due process, the client shall be entitled to a full refund should they not wish to give Mut-Con an opportunity to remedy any shortcomings.
Support
Unless otherwise agreed, all Mut-Con websites come with full support for a period of one month. For websites purchased with a domain and hosting package, this support extends to said domain and hosting. Support beyond the one-month period may be provided at an additional cost unless otherwise discussed with Mut-Con. Clients shall not attempt to abuse the support period by making significant alterations to their website that would have constituted a different website had they been presented when the original scope of the website was discussed.
